Ademola Adeleke wins as appeal court rules in his favour concerning Osun election

The ruling thus nullified an earlier judgement of a lower court which disqualified the governorship candidate of the PDP in the 2018 election in Osun on the basis of his certificates. Television Continental reports that the ruling of the appeal court reaffirmed Adeleke’s qualification and eligibility to contest the office of the governor of the state as earlier delivered by a high court in Osogbo.

                        

According to the report, the high court in Osogbo had ruled that the governor is qualified having been educated up to secondary school level. Not satisfied with the ruling, the petitioners had headed to the appeal. It was learnt that the appeal court dismissed the petitioners’ claim on three grounds including that the court had no jurisdiction to hear the case. The second ground on which the case was dismissed was that the petitioner has no locus standi to file the case and third was that the matter was brought to court outside the stipulated 14 days after the conduct of the primary

It was also reported that the Independent National Electoral Commission (INEC) said it can issue a certificate of return to Senator Ademola Adeleke of the Peoples Democratic Party (PDP) only if Governor Gboyega Oyetola of Osun state fails to appeal the judgment of the tribunal that sacked him within 21 days.
